1. Introduction

  • These Terms & Conditions (“Terms”) govern the access and use of cleaning services (“Services”) provided by AusCareFS, a business operating in Melbourne, Australia.
  • By booking or using our Services, you (“Client”, “you”, or “your”) agree to be bound by these Terms.
  • If you do not agree with these Terms, you must not use our Services.

2. Services Provided

  • We provide professional residential and commercial cleaning services as described on our website or as otherwise agreed in writing.
  • Scope of Services will be confirmed in your booking confirmation.
  • Any additional tasks requested outside the agreed scope may attract extra charge

3. Bookings and Availability

  • Bookings must be made through our website, phone, or authorised agents.
  • All bookings are subject to availability and confirmation.
  • Minimum booking times may apply and will be specified at the time of booking.

4. Fees and Payments

  • Fees for Services are set out in our pricing schedule or agreed at the time of booking.
  • All fees are payable in Australian Dollars (AUD).
  • Payment methods accepted include credit/debit card, bank transfer, or other methods displayed at the time of booking.
  • Payment must be made in full prior to or at the time of Service unless otherwise agreed in writing.

5. Cancellations and Rescheduling

  • You may cancel or reschedule your booking subject to our Cancellation Policy.
  • Cancellations made less than 24 hours before the scheduled Service may incur a fee equal to up to 50% of the service cost.
  • If we are unable to provide Services due to unforeseen circumstances, we reserve the right to reschedule or cancel with notice.

6. Refunds

  • Refunds will only be provided in accordance with our Refund Policy and the Australian Consumer Law.
  • Where Services are not delivered with due care and skill, you may be entitled to a remedy.

7. Client Obligations

  • You must provide safe, lawful, and reasonable access to the premises where Services are to be carried out.
  • You must notify us of any health, safety, or security risks prior to the commencement of Services.
  • You must secure all valuables before Services are carried out.

8. Our Obligations

  • We will deliver Services with due care, skill, and in a professional manner.
  • Our staff are trained, insured, and bound by workplace health and safety standards.
  • We reserve the right to refuse or withdraw Services if conditions are unsafe, unlawful, or unreasonable.

9. Insurance and Liability

  • We hold public liability insurance and workers’ compensation insurance as required by Australian law.
  • To the maximum extent permitted by law, we are not liable for incidental, indirect, or consequential damages arising from the Services.
  • Nothing in these Terms limits your rights under the Australian Consumer Law.

10. Workplace Health and Safety

  • We comply with the Occupational Health and Safety Act 2004 (Vic) and all applicable WHS regulations.
  • Our staff may refuse tasks that pose risks to health and safety.

11. Privacy

  • We collect, use, and store your personal information in accordance with our Privacy Policy.

12. Termination

We may suspend or terminate Services where:

  • You breach these Terms;
  • Unsafe, illegal, or inappropriate conduct occurs; or
  • Payment is not made as agreed.

13. Force Majeure

We are not liable for delays or failures in performance caused by events beyond our reasonable control, including but not limited to weather events, strikes, or pandemics.

14. Governing Law

  • These Terms are governed by the laws of Victoria, Australia.
  • Any disputes shall be resolved by the courts of Victoria.
